| Date sent | What was requested | District reply | Documents |
|---|---|---|---|
| Oct. 23, 2026 | Eleven categories: court filings in the City of Fresno cases, agreements and correspondence with the City, judgment payments, the 2023 sewer surcharge, the WAS water surcharge, bills payable and budget reports, the last three rate studies, ten years of audits, the district’s records request to the County in the elections boundary matter, and PG&E and backup-power records. Sent to the general manager. | The general manager forwarded the request to the board and counsel the same morning. District counsel replied: “We don’t respond to the same public records act request more than once. This is a conglomerate of multiple requests he has made previously that I have responded to before. No further response is necessary.” When Director Christine Silva asked counsel to identify the exemptions and the person responsible for the decision, he replied that “the exemptions are all encompassing and the statutes are cited. It is obvious who made the decision.” | Request and replies |
| Aug. 24, 2026, 2:38 AM | PG&E bills and usage data, monitoring and outage records, and backup-power and emergency-preparedness records for all district wells and facilities, 2020 to present. Sent to the general manager, with copies to counsel and the board. | No reply on file. | Request |
| Aug. 24, 2026, 1:25 AM | Restated and expanded the Aug. 13 request: month-by-month legal billing, records of the City of Fresno litigation, related financial records, and rate-increase materials. A follow-up was sent Sept. 17, 2026. | District counsel, Aug. 24: “We’re done I am not responding to this again. Your remedies to sue. Go for it and see what happens.” District counsel, Sept. 17: “There isn’t going to be a further response.” | Request, follow-up and replies |
| Aug. 13, 2026 | Records of the City of Fresno sewer litigation: court filings, legal costs paid, settlement agreements, correspondence with the City, enforcement records, and records of the payment plan and fee increases. Sent to the general manager, with a copy to counsel. | District counsel replied the same day that a board member cannot successfully make a public records request of the district because a board member cannot sue the district to enforce it, and, in a correction sent later that morning, that the district would not respond further. | Request Replies |
Under the Public Records Act, an agency must tell a requester within 10 days whether it will provide the records (Government Code section 7922.535), and a denial must be in writing and name the person responsible (section 7922.540). Government Code section 7921.305 provides that an elected official may access an agency’s public records on the same basis as any other person. Anyone may request district records; see “Request a record” in the sidebar.
