City of Fresno sewer cases

The City of Fresno treats the district’s sewage under an agreement effective January 1, 2007, which replaced a 1976 contract and settled a 2005 lawsuit between the two agencies. Under the agreement the district bills its sewer customers at City rates and pays the City, and the City may audit the district’s sewer records. The disputes below grew out of that agreement. The background is set out in the Court of Appeal’s 2022 opinion (F080769), linked below.

1. Audit case: City of Fresno v. Pinedale County Water District (2008)

Madera County Superior Court No. MCV043413 (filed in Fresno County, transferred to Madera; Madera filing date Aug. 15, 2008).

The City sued to enforce its right to audit the district under the 2007 agreement. After a trial, the court ruled for the City on Oct. 4, 2011, allowing the audit; the City’s costs and attorney fees ($86,658.53) were added by an amended judgment in January 2012. On Sept. 17, 2013 the Court of Appeal affirmed both the judgment (F064112) and the orders awarding the City costs and attorney fees (F064758). A second amended judgment for $127,515.84 was entered April 6, 2015.

2. Writ to compel payment: City of Fresno v. Pinedale County Water District (2017)

Fresno County Superior Court No. 17CECG02055, filed June 16, 2017, transferred to Kings County Superior Court No. 18C-0051, where it remains.

The City petitioned for a writ of mandate requiring the district to pay the 2015 judgment. On Nov. 8, 2017 the Fresno court granted the district’s motion to transfer the case to Kings County. In Kings County the court ruled for the City, and the Court of Appeal affirmed in 2022 (F080769). The district’s later appeal of a March 7, 2024 enforcement order was decided for the district in 2025 (F088121) because no writ had been issued or served. The Kings docket shows further appeals filed May 2, 2025, April 24, 2026 and Aug. 26, 2026, and a City request for a writ of mandate in September 2026.

3. District suit to rescind the agreement: Pinedale County Water District v. City of Fresno (2018)

Fresno County Superior Court No. 18CECG02957, filed Aug. 9, 2018; transferred out of Fresno County Dec. 5, 2018.

The district sued to rescind the sewer agreement, arguing it was illegal. The City responded with a demurrer and a motion to strike, and the district moved to transfer the case. The Court of Appeal’s 2022 opinion (F080769) addresses the district’s rescission claim.

Pinedale County Water District v. Kus (2026)

Fresno County Superior Court No. 26CU02177, filed July 29, 2026. Respondent: James A. Kus, Fresno County Clerk and Registrar of Voters.

The district petitioned for a writ of mandate concerning the boundary map the Registrar uses to decide who may vote in and run for district elections, in particular residents of the district’s sewer-only service areas. The board authorized the suit at a special meeting on July 22, 2026, as reported in open session on Aug. 12. The Registrar, represented by County Counsel, opposed the district’s ex parte application, stating that the opposition addressed only procedural issues and not the merits: service and personal jurisdiction, a procedural fact it said the application misstated, the standard for a temporary restraining order, and the district’s delay. At an ex parte hearing on Aug. 3, 2026 the court denied the district’s request for an alternative writ. The district filed a first amended petition on Oct. 2, 2026. According to the amended petition, it asks the court to stop the Registrar from certifying the results of the Nov. 3, 2026 election for district directors or, alternatively, to invalidate the results and require a new election across the service areas shown on maps LAFCo adopted Feb. 2, 2026. The case is pending. The original petition is not among the filings posted here.

Customer billing lawsuit (2022)

In November 2022 a district customer sued the district in Fresno County Superior Court over billing. On May 1, 2025 the court sustained the district’s demurrer without leave to amend, and a judgment of dismissal was entered May 27, 2025. On Oct. 2, 2025 the court denied a request to reopen the case, finding it no longer had jurisdiction. The plaintiff is a private individual, so the case number and filings are not posted here.
